for AfricInvest fund raising and investment activities

This privacy statement provides information regarding the processing of personal data carried out by AfricInvest in the course of our fund raising and investment . It describes how AfricInvest, in the course of those activities, processes personal data relating to individuals (you) who are either themselves the direct or indirect beneficiaries of the AfricInvest’s investment activities or who are connected with investors (such as directors or officers). It includes important information about your rights under EU data protection law.

Legal Basis

Personal data are processed by AfricInvest in accordance with in accordance with Regulation (EU) 2018/1725 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data, and repealing Regulation (EC) No 45/2001 and Decision No 1247/2002/EC.

The processing of personal data carried out by AfricInvest is necessary so that AfricInvest can comply with its legal obligations or for the performance of contractual obligations. In some cases the legal basis will be that the processing is necessary for legitimate interests pursued by AfricInvest. Consent is in general not the legal basis justifying our processing of your personal data. If we do propose to rely on your consent we will make this clear at the time.

Why do we process your personal data?

AfricInvest processes your personal data as reasonably necessary so that it can conduct and manage its fund raising and investment activities, in a reasonable and proper matter, in accordance with applicable law and regulation. Specifically, we process your personal data for the following purposes:

  •  Verifying the identity of the beneficial owners of (i) the investors in our funds, (ii) shareholders, directors and managers of the Portfolio Companies we would invest in and (iii) service providers and business partners with whom we carry out business (together the “Clients”), as part of Client onboarding processes and screening against sanctions lists.
  • Screening the beneficial owners for different risk categories: Illicit sources of funds, money laundering, political exposure, terrorism financing, varieties of financial fraud and all kinds of conduct that have the potential to pose reputational risks to AfricInvest and its stakeholders.
  • managing our relationships with our counterparties (and potential counterparties) in the context of our fund raising and investment activities.
  • Reflecting an investor’s ownership interest and managing and administering its interest on an ongoing basis
  • managing our information technology and ensuring the security of our systems
  • investigating and responding to complaints, and establishing, exercising and defending legal claims, which may arise in the course of our  fund raising andinvestment activities
  • cooperating with public authorities in our countries’ of activities, and with competent regulatory, prosecuting and tax authorities
  • credit and other risk assessment and control
  • maintenance of appropriate records

What personal data do we process?

We collect and process basic identifying data (such as name, contact details, title, job description and date of birth), information about your involvement in our fund raising and investment transactions (including, in accordance with standard market practice, professional education and curriculum vitae) We also collect and process background information about individual beneficiaries (and beneficial owners of and other key individuals associated with beneficiaries), used for know-your-client, anti-money-laundering or sanctions compliance purposes (for example, information contained in a passport or driving licence, or available from a public register). We may also collect nationality, place of birth, family status, occupation, tax identification, subscriptions, credit history, correspondence records, passport number, bank account, source of funds, gross income, net wealth and details relating to an investor’s investment activity and experience.

We can also use your email address for the purpose of sending our periodic newsletter, which serves to keep our investors, portfolio companies and contacts informed of important developments about the AfricInvest Group. If you want to stop receiving our Newsletter, a link is provided with each newsletter allowing to remove your name from the mailing list.

Where do we obtain your personal data?

We may obtain your personal data directly from you (or from a business or an organization that you represent or with which you are associated), or from an intermediary involved in the fund raising or investment transaction. If you are an individual beneficiary (or a beneficial owner of or other key individual associated with a beneficiary) of our investment products, we may also collect some information about you from international sanctions lists and other publicly available sources.

To whom is your data disclosed?

We may disclose personal data about you to:

  • internally, to AfricInvest relevant services.
  • certain investors in AfricInvest funds, upon their request.
  • the legal entity, organisation (if any) with which you are associated, and intermediaries and other organisations involved in our transactions, in the ordinary course of communications relating to our investment activities.
  • third party mandators, or co-investors to our investment products,
  • our legal advisors
  • service providers who hold and process your personal data on our behalf, under strict conditions of confidentiality and security.

How long do we keep your personal data?

We keep your data as long as is necessary for the purposes described in this privacy statement. Any personal data collected and processed in the context herein will be retained by AfricInvest for a maximum period of five years following the termination of the business relationship.

What are your rights and how can you exercise them?

You have the right to ask us to:

  • provide you with a copy of your personal data;
  • correct your personal data ;
  • restrict our processing of your personal data.
  • To allow you to exercise the right to data portability;

Particular Duties

AfricInvest Morocco a subsidiary of AfricInvest group collects and processes personal data of individuals who have contacted it within the scope of processing aimed at managing contacts via the website. This processing has been declared to the CNDP under number D-W-869/2023 dated 12/09/2023.

Through the “careers” form, AfricInvest Morocco collects your personal data for the purpose of managing contacts via AfricInvest’s website. This processing has been declared to the CNDP under number D-W-869/2023. The personal data collected may be transmitted to the data controller in Morocco only.
